High Court Orders DCI to Preserve Forensic Evidence in Samidoh Rape Case

The High Court in Nairobi has issued strict orders to protect forensic evidence in the rape case involving celebrated Mugithi star Samuel Muchoki, popularly known as Samidoh.

Justice Lawrence Mugambi, in interim orders on Thursday, September 4, directed the Directorate of Criminal Investigations (DCI) to preserve all evidence linked to the claims.

“Pending the hearing and determination of this application, an order of temporary preservation of evidence relevant to the Petitioner’s complaint,” Justice Mugambi declared.

DCI Put on High Alert

The judge instructed detectives to safeguard documentary, digital, and electronic materials connected to the case. He also ordered the DCI to immediately issue preservation notices to relevant custodians.

“This evidence must be protected to avoid tampering or destruction,” the court emphasized.

Failure to comply, Mugambi warned, would attract “penal consequences” against any officer or party disregarding the court’s orders.

Identity Protection for the Petitioner

Justice Mugambi further directed that the woman accusing Samidoh be identified only by her initials, M.R.W. He ordered all documents revealing her identity to be sealed, redacted, and restricted to the parties directly involved.

The decision aims to shield the complainant from victim shaming, which often silences survivors of sexual assault.

Court Timelines Issued

The court gave the petitioner seven days to serve the documents personally to the respondents or publish them in a newspaper with nationwide circulation.

After receiving the petition, the respondents will have another seven days to file their responses before the case proceeds.

Allegations Against the Artist

According to court filings, the woman accused Samidoh of sexually assaulting her. She claimed she had preserved crucial evidence, including audio recordings and electronic messages of their interactions.

The woman further requested that a forensic investigation be launched immediately as the hearing continues.

Growing Public Attention

The case has sent shockwaves across the entertainment industry. Fans of the popular Mugithi singer are closely following the developments, with many calling for fairness and justice.

Kenyans online voiced divided opinions. Some urged patience until investigations are complete, while others demanded accountability.
