Court Clears DIG Lagat as Petition Withdrawn Amid Ojwang’s Death Outrage

In a dramatic turn of events, the High Court on Wednesday allowed the withdrawal of a petition that had sought to bar Deputy Inspector General (DIG) of Police Eliud Lagat from accessing his office.

This decision effectively gives DIG Lagat the green light to return to work, despite ongoing investigations into the mysterious death of blogger and teacher Albert Ojwang in police custody.

Justice Rules on Evolving Circumstances

Justice Diana Kavedza allowed the application’s withdrawal, saying:

“The application is withdrawn as prayed. We will mention the matter on the 10th for directions on the main petition.”

The petitioner had initially sought conservatory orders to block Lagat from using any facilities of the National Police Service. However, their lawyer, Ndegwa Njiru, informed the court that the situation had “evolved beyond the initial application.”

Njiru told the court:

“We are now planning to seek leave to amend the petition to include new facts and developments.”

Ojwang’s Arrest and Death

Ojwang, who was arrested in early June for allegedly posting defamatory content about DIG Lagat, died under suspicious circumstances while in police custody. His arrest had been prompted by a complaint filed by Lagat himself.

According to Inspector General of Police Douglas Kanja:

“Lagat had officially lodged a complaint, which led to Ojwang’s arrest.”

Tragically, Ojwang was later found with serious injuries in custody and was pronounced dead shortly after.

Public Outrage and Police Pressure

Following the incident, Kenyans and various human rights organizations demanded accountability. Mounting pressure led Lagat to step aside from his duties on June 16 to allow independent investigations.

So far, at least six officers have been charged in connection to Ojwang’s death. Among them are Central Police OCS Samson Talam and Officer Mukwana, signaling a widening probe into police misconduct.

Family’s Cry for Justice

As investigations unfold, Ojwang’s family continues to seek answers. On Wednesday, July 2, they held a tearful requiem mass filled with grief and calls for justice.

His mother cried out:

“All we want is justice. Let those responsible face the law.”

His father added:

“This must never happen to another child. We demand the truth.”

Ojwang will be laid to rest on Friday, July 4.

As the case continues to gain national attention, all eyes remain on the justice system to see if true accountability will prevail.
