US Court Orders Relief for Diversity Visa Applicants, Including Kenyans

US Court Orders Relief for Diversity Visa Applicants, Including Kenyans

Kenyans selected for the United States Diversity Visa programme have received a major reprieve after a federal court intervened in a dispute over the Trump administration’s suspension of visa issuance.

The ruling issued on August 28, 2026, in the US District Court for the Northern District of California affected policies that had delayed the processing and issuance of Diversity Visas to applicants selected under the DV-2026 programme.

The case, brought by Diversity Visa applicants, challenged measures that had prevented some successful lottery applicants from completing the final stages of the immigration process.

Following the court order, the US Department of State confirmed that the December 2025 pause on Diversity Visa issuance was no longer in effect. However, the department subsequently announced a new pause on all DV visa issuances while it reviews the programme’s screening and vetting procedures.

The State Department said applicants can still submit their visa applications and attend scheduled interviews during the review, although visas will not be issued while the latest pause remains in place. Existing interview appointments generally will not be cancelled or rescheduled.

The development is particularly important for Kenyan applicants because DV-2026 has a strict deadline.

Under US immigration rules, successful Diversity Visa applicants must obtain their visas during the fiscal year for which they were selected. The DV-2026 programme ends on September 30, 2026, meaning visas cannot be issued under the programme after that date. Visa numbers could also run out before the deadline.

For applicants who have already submitted their DS-260 forms, attended interviews or completed other requirements, the court intervention could provide an opportunity for their cases to continue moving through the system.

However, being selected in the Diversity Visa lottery does not automatically guarantee permanent residency in the United States.

Applicants must still satisfy all eligibility and admissibility requirements, complete the required immigration procedures and obtain an available visa number before the programme closes.

The Diversity Visa programme provides up to tens of thousands of immigrant visas annually to eligible applicants from countries with historically lower levels of immigration to the United States. The programme is subject to regional allocations and a seven-percent country limit.

The legal developments have unfolded against heightened scrutiny of the programme by the Trump administration.

The State Department said its latest review followed national security and public safety concerns after a shooting at Brown University and the killing of an MIT professor. The department said the suspect in those incidents had entered the United States through the Diversity Visa programme.

Officials said the review is intended to examine potential weaknesses in the programme’s screening and vetting procedures, including how the identity and eligibility of selected applicants are established.

For Kenyan DV-2026 selectees, the situation remains time-sensitive.

The September 30 deadline leaves applicants with a narrow window to complete any outstanding requirements and secure their visas if they become available.]

The State Department’s August guidance also makes clear that the court order did not automatically grant visas to every affected applicant.

Instead, applicants must continue following the official process while monitoring developments surrounding the programme.

The court decision nevertheless represents an important development for Diversity Visa applicants who had been affected by the earlier suspension.

With the DV-2026 fiscal year approaching its September 30 deadline, Kenyan applicants will need to closely monitor official US government communications and ensure that their applications remain complete.
