Ferdinand Waititu Found Guilty in KSh 588M Graft Case

Former Kiambu governor Ferdinand Waititu and his wife, Susan Wangari, have been found guilty of corruption charges in a KSh 588 million scandal. The ruling, delivered by Chief Magistrate Thomas Nzioki at the Milimani Anti-Corruption Court, marks a significant victory in Kenya’s anti-graft fight.

What Were Waititu and His Wife Accused Of?

The two faced charges of abuse of office, conflict of interest, and fraudulent procurement. The court found sufficient evidence proving their involvement in the corrupt dealings.

“I’m convinced beyond reasonable doubt that the prosecution has proved the charges against the accused persons,” Magistrate Nzioki ruled.

However, the court cleared them of money laundering allegations.

How Did Waititu Defraud Kiambu County?

According to the Ethics and Anti-Corruption Commission (EACC), a company owned by Waititu’s family secured tenders fraudulently while he was governor. His administration awarded a KSh 588,198,328 contract for road construction in Thika, Limuru, Gatundu North, Juja, and Ruiru. The contract was skewed in favor of M/S Testimony Enterprises Ltd, a firm linked to Waititu’s close associates.

Twelve county officials who served under Waititu were also charged in the case.

The Long Road to Justice

The case, which started in 2019, saw multiple delays. In June 2023, the hearing was postponed when Waititu collapsed at his home and was rushed to Aga Khan Hospital. His lawyer, John Swaka, informed the court about his hospitalization, raising concerns about his health’s impact on the trial.

Despite the delays, the court finally delivered a verdict on February 12, 2025, sealing the fate of the former governor.

EACC’s Efforts to Recover Stolen Assets

The anti-graft agency has been pursuing Waititu’s wealth, valued at KSh 1.9 billion.Assets targeted for recovery include Delta Hotel, Jamii Bora building, Baraka Shopping Mall, and luxury homes in Runda. The EACC argues these properties were acquired using proceeds from corrupt deals during his tenure.

What Next for Waititu?

With the guilty verdict, the former governor now faces possible jail time and asset seizures. His conviction sends a strong message to public officials engaging in corruption. The ruling signals that justice, though delayed, will eventually catch up with those who misuse public funds.
