DPP Approves Murder Charges Against 9 Suspects in Utumishi Girls Fire Case

Nine suspects linked to the tragic Utumishi Girls Academy fire that claimed 16 lives are set to face murder charges after the Director of Public Prosecutions (DPP) approved their prosecution following months of investigations into one of Kenya’s deadliest school disasters in recent years.

The decision marks a major development in the high-profile case that has gripped the nation since the devastating blaze occurred on May 28, triggering widespread outrage and renewed debate over student unrest, school safety, and accountability within learning institutions.

In a statement released after reviewing evidence submitted by investigators from the Directorate of Criminal Investigations (DCI), the Office of the Director of Public Prosecutions confirmed that sufficient grounds existed to prosecute the suspects.

“Upon careful assessment of the evidence, the Director of Public Prosecutions has approved charges against the implicated students. The suspects will face sixteen (16) counts of murder arising from the incident,” the DPP stated.

The approval follows weeks of extensive investigations aimed at establishing the exact circumstances that led to the fire, which tore through a section of the school and left families, students, and the education sector in mourning.

Investigations Uncovered Critical Evidence

Immediately after the tragedy, detectives launched a comprehensive inquiry involving forensic experts, fire investigators, and crime scene specialists. Authorities sought to determine whether the fire resulted from an accident or a deliberate criminal act.

As investigations progressed, detectives reviewed surveillance footage, interviewed witnesses, and collected physical evidence from the scene.

According to investigators, CCTV footage obtained during the probe allegedly captured individuals believed to have played a role in starting the fire. The footage became a key component of the investigation and contributed significantly to the arrests that followed.

The suspects were subsequently detained as authorities continued gathering witness statements, forensic reports, and other evidence required to build a strong prosecution case.

After completing the investigations, the DCI forwarded the case file to the DPP for legal review and direction on the charges to be preferred against those implicated.

The approval of murder charges significantly escalates the legal implications of the case, transforming it from a fire investigation into a homicide prosecution carrying severe legal consequences if convictions are secured.

Growing Concern Over School Arson Cases

Beyond the Utumishi Girls tragedy, the DPP used the occasion to raise alarm over the increasing number of arson incidents reported in schools across Kenya.

Education stakeholders have in recent months expressed concern over a resurgence of student unrest, with several institutions experiencing fires, property destruction, and disruptions to learning programmes.

Government data indicates that more than 100 schools have recorded arson incidents, while over 200 institutions have reportedly been affected by unrest-related disruptions.

The growing trend has prompted calls for stricter disciplinary measures, improved counselling services, enhanced student engagement programmes, and stronger security systems within schools.

“The DPP expresses deep concern over the recent increase in reported incidents of arson and other related acts of criminal conduct in educational institutions across the country,” the prosecution office noted.

The DPP further warned that anyone found responsible for criminal acts in schools would face prosecution regardless of age, status, or position.

“We wish to caution students and members of the public that individuals found culpable of criminal offences of this nature will be held accountable in accordance with the law,” the statement added.

Families Seek Justice

For families affected by the tragedy, the latest development represents a significant step toward accountability and justice.

The deaths of the 16 learners shocked the nation and reignited discussions about student welfare, dormitory safety standards, emergency preparedness, and school management practices.

Legal experts note that the prosecution is likely to attract significant public attention given the scale of the tragedy and the serious nature of the charges involved.

Meanwhile, the DPP has assured the public that the prosecution process will be conducted fairly, independently, and strictly in accordance with the law.

“This matter will be handled with truth, fairness, and fidelity to the law,” the DPP stated, emphasizing the importance of delivering justice while safeguarding the rights of all parties involved.

As the suspects prepare to take plea, the case is expected to become one of the most closely watched criminal trials in Kenya’s education sector, with its outcome likely to shape future approaches to school safety and accountability nationwide.
