“I Cleared My Arrears” — Azziad Fights to Save Her Home
On Thursday, November 6, Azziad filed a case at the Commercial Court in Nairobi. She accused the Sacco of attempting to auction her apartment unlawfully, despite her efforts to settle the outstanding loan.
“I acquired the property legally. I’ve cleared my arrears. This auction is unjust,” Azziad stated in court documents.
“The Sacco deducted Ksh2.45 million from my savings on September 19, 2025,” she said. “That payment cleared all arrears.”
Despite this, she was shocked when auctioneers listed her apartment for sale on October 8, 2025.
“Auction Is Premature and Illegal” — Azziad Seeks Court Protection
Azziad argued that the Sacco’s move to auction the property was premature and violated their agreement. She cited a clause in the loan charge that restricted early repayment demands.
“Recital ‘B’ of the charge states the Sacco cannot demand repayment outside the agreed time,” her legal team argued.
She now wants the court to stop the auction and protect her rights as a borrower.
