Three-Judge Bench Dismisses Petition Seeking Isiolo Governor Abdi Guyo’s Removal From Office

Isiolo, Kenya – Isiolo Governor Abdi Guyo has survived a legal challenge to his leadership after a three-judge bench dismissed a petition seeking his removal from office over allegations of party hopping.

The petition, lodged in June 2023, accused Guyo of defecting from the Jubilee Party to the United Democratic Alliance (UDA), a move the petitioners argued amounted to automatic resignation under Kenya’s political party laws. They further claimed that both Guyo and his deputy, John Lowasa, had vacated their positions by virtue of the alleged defection, creating a void that should have been filled through a by-election.

On Friday, December 5, the court ruled that while party hopping remains unlawful in Kenya, the petitioners failed to provide sufficient evidence to prove that Guyo and Lowasa had indeed defected. The judges maintained that the accusations were unsubstantiated and therefore could not form the basis for removal from office.

Petitioners’ Arguments

Through their lawyer, the petitioners contended that the alleged defection undermined Kenya’s multi-party democracy and subverted the will of Isiolo residents. They sought conservatory orders to bar Guyo and Lowasa from running county affairs until the matter was fully determined.

“The automatic resignation by the Governor and his deputy created a constitutional void that must be addressed through a by-election. Their actions undermine the principles of multi-party democracy,” the petitioners argued in their submissions.

However, the court found no documentary or procedural evidence to support the claims, noting that the burden of proof had not been met.

Governor Guyo’s Response

Addressing members of the public after the ruling, Governor Guyo described the accusations as politically motivated and baseless. He accused his opponents of attempting to destabilize his administration through unfounded claims.

“Once again, those who attempted to mislead the public and undermine our leadership have been exposed and shamed by the truth,” Guyo said.

“The court threw out the petition after establishing that there was absolutely no evidence whatsoever that we ever resigned from or defected from the Jubilee Party,” he added.

Guyo further alleged that the same individuals who had pushed for his impeachment were behind the petition, insisting that their efforts were driven by political mischief rather than genuine concern for governance.

The ruling is seen as a significant relief for Governor Guyo, whose administration has faced political turbulence since he assumed office. Analysts note that the dismissal of the petition reinforces the judiciary’s role in safeguarding elected leaders from politically motivated challenges, while also underscoring the importance of evidence in electoral disputes.

Party hopping has long been a contentious issue in Kenya’s political landscape, with laws designed to prevent leaders from switching allegiances mid-term. However, enforcement has often proven difficult, particularly in cases where allegations are not backed by clear documentation.
