Ombudsman Asks TSC to Overhaul Teachers’ Pension System Over Delays

The Commission on Administrative Justice (CAJ), commonly known as the Ombudsman, has called on the Teachers Service Commission (TSC) to urgently overhaul its pension management system following persistent delays in the processing and payment of teachers’ pension and gratuity claims.

In a press statement released on Thursday, January 8, the Ombudsman said the proposed reforms are necessary to address systemic failures that have left retired teachers and bereaved families waiting for years to receive their rightful benefits. The recommendations follow an investigation launched after a surge in public complaints over prolonged pension delays.

According to the Commission, one of the key proposals is the re-establishment of a stand-alone pension unit within the TSC to specifically handle pension and death gratuity claims. The Ombudsman noted that such a unit would help streamline processes, improve accountability, and ensure timely settlement of claims.

“The Commission recommends the re-establishment of a dedicated pension unit within the Teachers Service Commission to enhance efficiency and reduce delays in the processing of pension and gratuity claims,” the statement read.

The investigation revealed that teachers who retired compulsorily experienced pension delays ranging between two and four years, while death gratuity claims often took between four and more than six years to be paid. The Ombudsman described the delays as excessive and unjustified, noting that they have caused significant financial and emotional distress to retirees and their dependants.

At the institutional level, the Commission found that delays within TSC offices were largely attributed to inadequate staffing, limited financial and technical resources, and weak supervisory structures. These challenges were compounded by the heavy workload placed on a small number of officers tasked with handling pension matters.

“The Commission established that the Pension Department is understaffed and overwhelmed, resulting in prolonged processing timelines that undermine service delivery,” the Ombudsman said.

The report also pointed to challenges on the part of claimants, including incomplete or incorrect documentation submitted by retirees or next of kin. In some cases, these errors significantly slowed down verification and approval processes.

Additionally, the Ombudsman cited technological shortcomings, noting that frequent outages of the Pension Management Information System (PMIS) and reliance on outdated communication methods further contributed to delays.

“The inefficiencies are exacerbated by frequent system downtimes and antiquated modes of communication, which hinder timely processing and tracking of claims,” the report stated.

More concerning, the investigation uncovered instances where local administrators allegedly colluded with families to misrepresent information about dependants, particularly in polygamous households or cases involving children born out of wedlock. Such practices, the Ombudsman noted, complicated verification processes and opened the system to abuse.

To address these challenges, the Commission recommended a comprehensive review of pension workflows, enhanced digitalisation, updated pension documentation, and the introduction of collaborative case-tracking tools. It also proposed the public disclosure of pending claims to promote transparency and regular training for pension staff to improve capacity.

In a bid to restore fairness, the Ombudsman directed the Pension Department to strictly enforce a verifiable “first-in, first-out” payment system.

“To ensure equity and transparency, all claims must be processed and paid strictly in the order in which they are received,” the Commission said.

The Ombudsman further urged the Cabinet Secretary for the National Treasury to ensure that pension funds are allocated and disbursed on time, warning that delays at the funding stage undermine even the most efficient administrative systems.

As pressure mounts, education sector stakeholders are expected to closely monitor TSC’s response to the recommendations, with calls growing louder for reforms that guarantee dignity and financial security for retired teachers.
