Former Kiambu Governor Waititu Hit With Fresh Charges While Serving Jail Term

Former Kiambu Governor Ferdinand Waititu’s legal woes have taken yet another twist. On Tuesday, November 11, prosecutors filed fresh charges against him, even as he continues to serve a 12‑year sentence at Kamiti Maximum Prison.

The new charges stem from remarks Waititu allegedly made during a rally at Ruiru Stadium in Kiambu County on September 29, 2024. Prosecutors argue that his words were deliberately provocative and carried the potential to destabilize peace across the country.

“If Gachagua goes home, President Ruto must also go.”

This statement, according to the prosecution, was reckless and specifically targeted hustlers, market vendors, boda‑boda operators, and clergy. They claim the remarks were intended to fuel tension and conflict among vulnerable groups.

Senior prosecutors told the court that Waititu’s conduct violated Section 94.1 of the Penal Code, which criminalizes comments likely to incite public unrest.

“We cannot allow leaders to use their platforms to sow division and threaten national stability.”

The Office of the Director of Public Prosecutions (ODPP) has scheduled a hearing for next week, signaling its determination to pursue the matter despite Waititu’s ongoing imprisonment.

A Troubled Political Career

Waititu’s fall from grace has been dramatic. Once a powerful figure in Kiambu politics, he is now serving a lengthy jail term after being convicted of conflict of interest and dealing with suspect property.

His lawyers have repeatedly attempted to secure his release. In September 2025, they launched another bid but failed after being unable to raise the required bank guarantee. High Court Justice Lucy Njuguna dismissed the application, ruling that such efforts were merely delaying the judicial process.

Earlier this year, Waititu briefly tasted freedom after securing a Ksh53 million bond pending appeal. However, his hopes of overturning the conviction were dashed when the appeal was rejected.

In addition to the 12‑year prison term, the former governor was barred from holding public office for 10 years, effectively ending his political ambitions.

Political Shockwaves

The fresh charges have reignited debate over the role of political rhetoric in Kenya’s fragile democracy. Analysts warn that inflammatory remarks from influential figures can easily spark unrest among vulnerable groups.

Civil society leaders have also weighed in. Outside the courthouse, one activist declared:

“This is a wake‑up call to all leaders that words carry consequences. We must protect our democracy from reckless statements that undermine peace.”

Meanwhile, supporters of Waititu argue that the charges are politically motivated, designed to silence dissenting voices. His legal team maintains that the remarks were taken out of context and did not amount to incitement.

As the court prepares to hear the case next week, Kenyans will be watching closely to see whether the former governor’s troubles deepen further—or whether he manages to mount a successful defense.
