Embu High Court Secures Mbeere North By-Election Materials Ahead of Petition Hearing
The Embu High Court has taken a decisive step to safeguard electoral integrity by ordering the secure preservation of all materials used in the Mbeere North parliamentary by-election, as preparations intensify for the hearing of a petition challenging the outcome.
In orders issued on Thursday, January 15, Justice Richard Mwongo directed the Independent Electoral and Boundaries Commission (IEBC) to place all election materials under the custody of the court, in a move aimed at ensuring transparency, accountability, and public confidence in the judicial process.
Under the directive, the sensitive materials will be stored in a secure room fitted with six padlocks, with each of the six parties involved in the petition holding a separate key. The court will procure the padlocks, and no single party will have unilateral access to the room.

“The order I will be making is that all the preserved materials be brought into the custody of the court. You will be shown where the materials will be kept. We have places for six padlocks, and each party will be given their key and padlock that will be purchased by the court,” Justice Mwongo stated.
The judge explained that the unusual but strict arrangement was informed by the nature of the petition and the need to protect the credibility of the court throughout the proceedings.
“I thought seriously about this because when I read the petition and the responses, I felt the confidence of the court is going to be looked at from different angles if we are not very clear about who is in control of the process,” he added.
Justice Mwongo further ruled that the storage room would remain under round-the-clock security and warned that access would only be granted when all parties were present. He cautioned that any party whose absence causes delays risks losing its access rights.
“If a party fails to attend on a scheduled date and causes unnecessary delays to the others, the padlock will be broken and that party will forfeit access to the safe room,” the judge warned.
The orders were issued during a pre-trial conference convened to set the framework for managing the petition, including timelines and procedural safeguards. All parties present welcomed the court’s decision, describing it as a fair and secure method of preserving materials that will play a central role in determining the outcome of the case.
The conference also sought to ensure compliance with the legal requirement that election petitions be heard and concluded within six months. Justice Mwongo reiterated that the court was committed to adhering strictly to this timeline to avoid unnecessary delays.

The petition challenging the election of Leonard Wamuthende as the Member of Parliament for Mbeere North was filed by two registered voters. The petitioners are seeking the nullification of the by-election results and a fresh poll, citing alleged electoral irregularities.
Among the key claims raised is an assertion that Wamuthende was not a registered voter at the time of the election. The petitioners also allege inconsistencies in the winner’s identity, claiming that mismatched names appeared across nomination documents, voter registers, and election materials.
They point to the use of two names—Leonard Wamuthende Njeru and Leonard Muriuki Njeru—which they argue raises serious questions about the validity of the candidature and the integrity of the election process.
The court has scheduled the official hearing of the petition to begin on March 9, 2026. Justice Mwongo indicated that judgment is expected to be delivered on or before June 21, 2026, although the court is targeting May 21, 2026, for the final determination.

As the case moves forward, it is expected to draw close public scrutiny, with its outcome likely to shape future jurisprudence on election management, candidate eligibility, and the handling of disputed electoral materials.
